Pe scurt, radierea ipotecii \u00eenseamn\u0103 \u0219tergerea garan\u021biei (ipoteca) din cartea funciar\u0103. Astfel, radierea ipotecii este un demers administrativ pe care proprietarul trebuie s\u0103-l ini\u021bieze, nu un proces automat.<\/p>\n<p>Pentru a finaliza radierea ipotecii, apar dou\u0103 roluri:<\/p>\n<ul>\n<li><strong>Banca (creditorul)<\/strong> este cea care confirm\u0103 \u00een scris c\u0103 datoria a fost achitat\u0103 \u0219i emite o declara\u021bie de radiere. \u00cen cazul programelor Prima\/Noua Cas\u0103, banca solicit\u0103 \u0219i acordul de radiere de la Fondul Na\u021bional de Garantare (FNGCIMM). Banca trebuie s\u0103 fac\u0103 aceste demersuri \u00een termenul legal.<\/li>\n<li><strong>Proprietarul (debitorul)<\/strong> este cel care colecteaz\u0103 actele de la banc\u0103, le autentific\u0103 la notar \u0219i depune cererea de radiere la Oficiul de Cadastru \u0219i Publicitate Imobiliar\u0103 (OCPI). Proprietarul trebuie s\u0103 se asigure c\u0103 radierea este finalizat\u0103; altfel, ipoteca va r\u0103m\u00e2ne \u00eenscris\u0103 \u0219i poate \u00eengreuna viitoarea v\u00e2nzare sau refinan\u021bare.<\/li>\n<\/ul>\n<h2>Pa\u0219ii pentru radierea ipotecii<\/h2>\n<p>\u00cen general, procedura implic\u0103 urm\u0103toarele etape:<\/p>\n<ol>\n<li>\n        <strong>Ob\u021binerea documentelor de la banc\u0103<\/strong><\/p>\n<p>Dup\u0103 plata ultimei rate, solicit\u0103 b\u0103ncii un certificat de stingere a creditului \u0219i o declara\u021bie de radiere a ipotecii. La creditele garantate de stat (Prima\/Noua Cas\u0103), banca va cere \u0219i acordul de radiere de la FNGCIMM. Potrivit informa\u021biilor oficiale, FNGCIMM emite acordul de radiere doar la solicitarea b\u0103ncilor, iar termenul general de solu\u021bionare este de 30 de zile.<\/p>\n<\/li>\n<li>\n        <strong>Autentificarea la notar<\/strong><\/p>\n<p>Declara\u021bia de radiere emis\u0103 de banc\u0103 trebuie autentificat\u0103 de un notar. Notarul \u00eentocme\u0219te un act numit \u00eencheiere de radiere \u0219i \u00eel transmite electronic c\u0103tre OCPI.
